Are U shushing me—they only are out 4 mil for him, lessee, 15 from us, 15+ from the orange cows, plus this and all his “fees” he was able to charge at each place. Damm, what a job! Is there a college major for this? Just my luck i missed it.

I’m not even sure his resume justifies that. He may need to drop down a division and restart his coaching journey.

It’s not specific to college football… all business leaders get this stuff baked into their contracts.

Duh… my issue is not with living up to the contract, it’s the structure of the contract itself. My beef is GENERALLY with all contracts in the industry, not just this one contract. It’s the result of inflation due to agent involvement.

They guaranteed money based on the belief and his representation that he would deliver.
HE DID NOT.

Again, this isn’t just specific to Herman, it’s across the board.

Here’s the way I would structure a contract:
$500,000 per WIN, guaranteed for three years (add kickers/incentives if you want)

If during the term, YOU want to get out of the contract then you need to return 1/2 of what we paid you during the contract term. (That would be if you’ve had success and then are getting poached by another school.)

If during the term, WE want to get rid of you because you didn’t live up to expectations, then we will pay you 1/2 of what we paid you during the contract term. (Our buyout would be greatly reduced if you SUCKED but we would still owe you something.)

We were turned down by the B12 when Herman was our HC; however, he would have left for UT regardless.
